Please carefully read the following terms and conditions before using our services. By subscribing to our service, you acknowledge and accept these terms and conditions.

1. Description of Internet Service Availability

Next Thing Networks Limited (“Next Thing Networks”) provides high-speed internet access technology at Enabled Locations, governed by the following terms and conditions.

  • Service Description: Next Thing Networks offers access to the internet at Enabled Locations, providing support and connection information through our website (www.nextthingnetworks.co.ke), distributed fliers, SMS, or phone calls.

  • Internet Packages: Our internet packages offer speeds up to the maximum value assigned, ensuring reliable connectivity. Speeds are shared among users, with average speed designed to match normal usage.

  • Billing Period: The billing period for internet packages is 30 days.

2. Access to Internet

  • Accuracy of Information: You agree to provide accurate, complete, and current information to Next Thing Networks for billing and customer support purposes.

  • Account Status: Your account must remain in an ACTIVE status for continued access. Payment reminders will be sent five days before the due date, with suspension occurring if payment is not received by the due date. Reactivation is possible upon payment.

3. Disruption of Service

  • Fail-Safe Disclaimer: Our services are not intended for use in situations requiring fail-safe performance. We are not liable for any inconvenience, loss, or damage resulting from interruption of services beyond our control.

4. Acceptable Use Policy

  • Scope: The Acceptable Use Policy (AUP) outlines acceptable uses of the internet and is not exhaustive.

  • Prohibited Activities: Users agree not to engage in activities such as transmitting unlawful material, interfering with network functionality, or violating applicable laws.

  • Cooperation with Authorities: Next Thing Networks may cooperate with legal authorities and third parties in investigating suspected violations of the AUP.

5. Fair User Play Implementation

  • Capacity Capping: Fair User Play implementation involves capacity capping to ensure fair internet usage. Users exceeding proposed data volumes may experience throttled speeds. Internet resellers are advised to purchase dedicated capacity.

6. Notification and Throttling

  • Usage Notification: Users will be notified when 98% of the maximum data bundle is attained before internet speeds are throttled down.

  • Throttled Speeds: Throttled speeds will be maintained until the end of the billing period.

7. Disclosure of Information

  • Lawful Requests: Next Thing Networks may disclose some or all of your communications and activities in response to lawful requests by governmental authorities, including judicial orders.

8. Termination

  • Next Thing Networks Termination: Next Thing Networks may terminate this Agreement and cancel your access to the Internet with a 30-day notice and at any time for reasons including, but not limited to, violation of the Terms and Conditions or engaging in illegal activity.

  • Client Termination: Clients can terminate the agreement at the end of their account billing period. No reimbursement will be provided for terminations before the account due date.

9. Service Level Agreement (SLA)

  • Scope of Support: Support is limited to Next Thing Networks core and radio infrastructure up to the customer premise equipment.

  • Resolution Times: Faults related to the fiber and wireless network within our infrastructure will be resolved within specified timeframes, ranging from 1 hour for minor complaints to 36 hours for major faults.

  • Compensation: Compensation for outages will be provided by extending the expiration due of the customer account by the number of days the client has not had service in cases where Next Thing Networks breaches the SLA.

10. Notice of Problems or Complaints

  • Reporting Problems: Users experiencing problems accessing or using the Internet should report the problem by calling 0207903950 or emailing [email protected] and [email protected].

11. Modifications

  • Terms Modifications: Next Thing Networks may modify these Terms and Conditions at its sole discretion. Notification of changes will be sent to clients via SMS one month in advance.

12. Indemnification

  • Defend and Indemnify: Users agree to defend, indemnify, and hold Next Thing Networks harmless from any losses, claims, damages, costs, and liabilities arising from their use of the Internet or breach of the Terms and Conditions.

13. Governing Law and Jurisdiction

  • Governing Law: This agreement is governed by the laws of Kenya. Any dispute or claim arising from this agreement shall be settled exclusively by the courts of the Republic of Kenya.
